(Oral) In the present protection petition, on 27.02.2023, following order was passed by this Court:- "By way of present petition, direction has been sought to respondents No.1 to 3, to protect the lives and liberty of the petitioners by restraining respondent No.4 to not to harass and interfere in the peaceful live-in relationship fo the petitioners.

Counsel for the petitioners submits that petitioner No.1 - Jyoti Devi, was earlier married to one Ranjit Sah, r/o village Anaribad, Distt. Dadbanga, Bihar. But, he died about 11⁄2 years back. Out of the said wedlock, two children aged about 3 years and 5 years, were born, and who are staying at present with petitioner No.1.

Counsel for the petitioners further submits that petitioner No.2, is already married to one Ganga Devi d/o Sushil Mandal, r/o 30/B, Mauli Jagran Part-2, Sunder Nagar. Out of the said wedlock, two children were born, in which, one child is staying with petitioner No.2 and another child is staying with earlier wife of petitioner No.2 i.e. Ganga Devi. It is noticed that in the present petition, there is no explanation that how the future of the four minor children would be looked after by the petitioners. Rather, petitioner No.2, who is already married person, has neither got divorced from his first wife (Ganga Devi), nor she has been impleaded party in the present case.

Counsel for the petitioners seeks time to get necessary instructions in regard to the aforementioned observations. Adjourned to 16.03.2023. "

At the very outset, learned counsel for the petitioners seeks permission to withdraw the present petition.

Dismissed as withdrawn.
