**** JAISHREE THAKUR, J.(Oral) This Court proposes to dispose of the above referred two petitions by this common order as the facts are the same. For the sake of brevity, facts are being taken from CRM-M-13110-2018. This petition i.e. CRM-M-13110-2018 has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 52 dated 24.02.2017 under Section 376, 307 & 506 IPC, registered Satyawan 2018.05.10 16:52 I attest to the accuracy and authenticity of this document High Court Chandigarh
CRM-M-13110-2018 -2at Police Station Division No.2, District Police Commissionerate Ludhiana, District Ludhiana, whereas the second petition i.e. CRM-M-11529-2018 had been preferred for quashing of the order dated 14.12.2017 whereby the petitioner has been declared as a proclaimed offender in the said FIR. Learned counsel for the petitioner contends that after the first bail application has been dismissed, the matter was compromised between the parties as would be evident from Annexure P-4 dated 22.08.2017. Since the matter had been compromised, the petitioner herein preferred CRM-M43241-2017 which came to be dismissed as withdrawn on the ground that he became aware that he had been declared as a proclaimed offender.
Learned counsel for the petitioner herein urges for grant of anticipatory bail on the ground that the matter stands compromised between the parties, however, this Court is not inclined to interfere in the matter at the present moment. The petitioner herein is directed to aproach the trial Court and file an application to have the order dated 14.12.2017 set aside and in case such an application is preferred the same be decided expeditiously, preferably within a period of two days. A photocopy of this order be placed on the file of the connected case.
