Prayer made in the present petition to appoint the petitioner to the post of Deputy Director/District Sainik Welfare Officer, might not due to efflux of time, even be surviving.

Learned State counsel refers to paras 2 and 3 of the preliminary objections of the written statement dated 28.11.2003 filed by respondent Nos.1 and 3, wherein the petitioner was considered for appointment as Ex-service man, but was found unsuitable and it has been specifically denied in para 5 on merits that as a matter of fact, only 3 candidates of Scheduled Caste category including the petitioner had appeared, while Lt. Col. Jaspal Singh was found suitable and the other two posts reserved for the said category, could not be filled and the posts were readvertised on 25.04.2003, Annexure R-3, wherein also the petitioner had appeared for interview on 07.07.2003, as such the present petition deserves to be dismissed.
