Vide order dated 11.02.2020, CRM-M-29633-2019 was dismissed as having been rendered infructuous, which reads as follows:- "Reply has been filed in the Court by the State counsel. which is taken on record. In para No.2 of the reply, it is mentioned that FIR was registered on the basis of a complaint moved by complainant-respondent No.2, Shri Chand alleging that the petitioners have wrongly taken possession of his 1/3rd share of the joint land as well as electricity meter installed on the Tubewell. Thereafter, the matter was investigated. However, allegations in the FIR could not substantiated. Therefore, the FIR has been cancelled in terms of the final report dated 1.12.2019 and such report would be forwarded to the court of competent jurisdiction at the earliest after complying with the procedural requirements.
On the other hand, Mr.Shri Chand, complainant who is present in the Court, has contended that the investigating JITENDER KUMAR 2020.02.28 15:35 I attest to the accuracy and integrity of this document Chandigarh
COCP No. 805 of 2020 -2agency has wrongly prepared the cancellation report. If so aggrieved, on getting notice, the complainant may file a protest petition in the trial court.
In view of above observation, the present petition has become infructuous, and is disposed of accordingly." Petitioner has filed this petition against 28 persons, which include private persons, police officials and civil authorities. In order dated 11.02.2020, passed in aforesaid petition, there is no direction, which is to be complied with. Filing of this petition is sheer misuse of process of Court. At this stage, petitioner tenders unqualified apology and seeks withdrawal of this petition.
Dismissed as withdrawn.
The petitioner is advised to be careful in future and avoid filing such frivolous petitions.
