I have heard learned counsel for the parties as well as learned Harpal Singh Parmar 2017.08.02 16:44 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-12291 of 2017 [2] State counsel appearing for the respondent-State and have gone through the record.

From the record, I find that it is a case of version and crossversion. It is yet to be decided by the trial Court as to who was the aggressor party on the basis of evidence. As per the complainant's version, the petitioners were armed with `Datar' and had inflicted injuries on nonvital parts on the persons of Jasbir Singh and Gurjinder Singh. The petitioners have already joined the investigation. They are not required for custodial interrogation. No useful purpose will be served by sending the petitioners to custody.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 7.4.2017 passed by this Court granting interim bail to the petitioners is made absolute. However, the petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. August 1, 2017.
