The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case DDR No.24 dated 1.10.2016 registered for the offences under Sections 323, 324, 506, 148 and 149 IPC and (Section 326 IPC, which was added later on) in FIR No.45 dated 28.9.2016 registered for the offences under Sections 452, 323, 506, 148 and 149 IPC and (Sections 25 and 27 of the Arms Act) at Police Station Jhander, District Amritsar Rural.

I have heard learned counsel for the petitioner and have gone through the record.

It is a case of version and cross-version. In the present case, the petitioner is stated to be armed with a `Datar' and grievous injury is attributed to him which he had given on the vital part of the body i.e. head. Keeping in view nature and gravity of the offences and the fact Harpal Singh Parmar 2017.04.07 17:52 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-12300 of 2017 [2] that `Datar' is still to be recovered, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
