(ORAL) The petitioner, through the instant petition is seeking setting aside of order dated 25.11.2022 whereby Judicial Magistrate Ist Class, Karnal has dismissed application of the petitioner under Section 311 Cr.P.C. to recall the complainant. The petitioner preferred revision petition before Sessions Court, however, he opted to withdraw with liberty to file revision before High Court. The Sessions Judge, Karnal, dismissed revision as withdrawn.

On being asked how revision is maintainable before High Court which is not maintainable before Sessions Court, learned counsel seeks permission to withdraw the present petition with liberty to move an appropriate application before the Sessions Court. Dismissed as withdrawn with liberty as aforesaid.
