R.P. Nagrath, J. (Oral) The instant petition has been filed under Section 482 Cr.P.C. for quashing of Criminal Complaint No. 1577 dated 15.09.2006 and subsequent summoning order dated 15.09.2006, pending in the Court of Judicial Magistrate, Panchkula. Cheques in question were issued in the year 2006. On the cheques having bounced, complaint under Section 138 of the Negotiable Instruments Act was filed in the same year. However, in the instant petition seeking quashing of order was filed in the year 2011 on the ground that tender of rent was made in eviction petition filed by the respondent in the year 2010.

It is not the ground for quashing of the complaint, summoning order and the subsequent proceedings. The instant petition is dismissed on merits with liberty to the petitioner to raise all the contentions taken herein before the trial Court.
