The prayer made in the present petition is for directing the respondents to grant pension and other pensionary benefits i.e. gratuity etc. with regard to the arrears and interest with regard to the service rendered by the petitioner.

Learned counsel for the petitioner submits that the petitioner retired on attaining the age of superannuation 31.10.2021, while disciplinary proceedings that were initiated against him had culminated in punishment on 17.02.2020 in stoppage of one annual increment without cumulative effect and in the criminal proceedings as on that date, even cancellation had been prepared on 06.07.2021. CWP-4198-2024 (O&M) - 2Co-delinquent Labhu Ram, Senior Assistant (retired from service on 31.05.2019) who was also involved in the same charge-sheet, had filed CWP-17006 of 2020, wherein it was directed that the gratuity that was withheld would be released alongwith 6% interest and he was not held entitled for interest on delayed payment up to the date when the proceedings in the charge-sheet were pending. 3.

In view of the above, the present petition is disposed of with a direction to release the gratuity alongwith 6% interest payable from 01.11.2021 till the same is released as also to regularize pension. 4.
