******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.91 dated 11.05.2011 registered for the offences punishable under Sections 406, 420, 120-B of Indian Penal Code, at Police Station Shimlapuri, Ludhiana as during the pendency of trial, he absented and warrants of arrest were ordered to be issued against him. Heard.

Learned counsel for the petitioner submits that petitioner has since surrendered before the trial Court and has been allowed interim bail under order dated 03.05.2018.

Learned State counsel endorses the submission of learned counsel for the petitioner.

CRM-M-13199-2018 -2Keeping in view the fact that trial is in progress but without expressing any opinion on the merits of the case, this petition is allowed and order dated 03.05.2018 is made absolute subject to following terms:- a. The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

b. In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh.

c. He shall not leave the country without the prior permission of the Court.
