This is the second petition instituted under Section 438 of the Cr.P.C., whereby, the petitioner has sought the concession of anticipatory bail, in case FIR No.138 dated 11.09.2023, under Sections 323, 324, 341, 34 of the IPC (Sections 326 and 307 of the IPC added subsequently, however, Section 307 of the IPC deleted subsequently), registered at P.S. Bullowal, District Hoshiarpur.

As a matter of fact, the petitioner had earlier also accessed this Court through filing CRM-M-56751-2023, thereby seeking an alike relief, as claimed herein. The petition (supra) was disposed of by this Court on 09.11.2023, thereby directing the petitioner to surrender before the learned trial Court concerned on 23.11.2023, and, a direction was also issued to the latter to, most expeditiously, decide his application for regular bail, if any moved.

However, the petitioner has, instead of surrendering before the learned trial Court concerned, now re-accessed this Court for grant of DEVINDER YADAV 2024.02.28 09:24 I attest to the accuracy and authenticity of this order/judgment

CRM-M-9916-2024 (O&M) 2024:PHHC:026309 anticipatory bail, merely on the ground that, offence under Section 307 of the IPC has been deleted in the present FIR.

Be that as it may, taking into consideration the hereinabove cited conduct of the petitioner, this Court is not inclined to grant the relief of anticipatory bail to the petitioner. Consequently, the instant petition is dismissed.
