Sunil Kumar @ Sushil Kumar v. State Of Punjab
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-12338-2017 Date of Decision : 12.05.2017 SUNIL KUMAR @ SUSHIL KUMAR ....PETITIONER
VERSUS
STATE OF PUNJAB ....RESPONDENT CORAM : HON'BLE MR. JUSTICE AMOL RATTAN SINGH
Present:
Mr. Karanjit Singh, Advocate for the petitioner. Mr. Vikas Chopra, DAG, Haryana.
----- AMOL RATTAN SINGH, JUDGE (ORAL) This petition has been filed under Section 439 Cr.P.C., for grant of 'regular bail' to the petitioner, in case FIR No.127 dated 30.07.2010, registered at Police Station Sultanwind, District Amritsar, for the alleged commission of an offence punishable under Section 21 of NDPS Act. Though, as per the custody certificate filed in Court today, the petitioner is seen to be involved in 10 other criminal cases, he is stated to have been in custody in connection with the FIR presently registered against him on 30.07.2010, since 04.01.2016, i.e. for 1 year and 4 months, with the charge still to be framed.
In the aforesaid circumstances, without making any comment on the actual merits of the case for or against the petitioner, it is considered appropriate to admit him to bail in the present case, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court. However, it is made abundantly clear that the grant of bail in this particular case would naturally have no bearing on any bail application submitted in connection with any other case.
Disposed of.
