Present writ petition has been filed under Article 226 of the Constitution of India, for issuance of a writ in the nature of mandamus directing the respondents to release balance payment of Rs.26,61,780/- qua the work of Periodical Repair of Plan Road, Old Bus Stand to BBM Road (BODR-1) executed by petitioner along with interest @ 12% per annum.

At the outset, learned counsel, on instructions from petitioner submitted that instead of pressing the present petition on merits, he would be satisfied in case the legal notice dated 12.02.2022 (P-3) is decided expeditiously.

In view of the agreed stand taken by both sides, but without going into the merits of the controversy, this writ petition is disposed off with direction to respondent No.5-The Executive Engineer, Provincial Division, PWD B&R Branch, Bathinda, to consider and decide the aforesaid legal notice dated 12.02.2022 (P-3) in accordance with law by passing speaking order within a period of 03 (three) months from the receipt of certified copy of this order.
