***** ARUN MONGA, J (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondent-Haryana Staff Selection Commission to accept the Sports gradation certificate dated 17.09.2021 (Annexure P-13) of the petitioner issued under the new Sports Policy dated 25.05.2018 (Annexure P14). 2.

Learned counsel for the petitioner submits that against the advertisement No.05/2019, the petitioner had applied for the post of Clerk under the ESP-General category. She cleared the written test and appeared for documents verification, which were found in order, but she was told that on the basis of grade D gradation certificate, she is not eligible to be considered. He submits that petitioner sports gradation certificate in the game of Karate has been wrongfully rejected.

Learned counsel for the petitioners submits that qua aforesaid grievance, petitioner caused issuance of a legal notice dated 05.01.2021 (Annexure P-16) but the same has not been adverted by the respondents till date. On advance service, learned State counsel joins proceedings and submits that competent authority shall take decision either way, on the pending legal notice dated 05.01.2021 (Annexure P-16), in due course. 5.

At this stage, learned counsel for the petitioner also agrees that let a final decision be taken, by the competent authority on the pending legal notice dated 05.01.2021 (Annexure P-16).

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per legal notice dated 05.01.2021 (Annexure P-16) and take a decision, in accordance with law. It would be appreciated if before passing the orders, competent authority would keep in mind the judgments rendered by this Court contained at Annexures P-17 & P-18. 8.

Let the needful be done within a period of 60 days from today. 9.

Disposed of accordingly.
