******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 70 dated 22.03.2011 registered for the offences punishable under Sections 341, 323, 324, 427, 506, 148 read with Section 149 of Indian Penal Code at Police Station Sadar Jalandhar. Heard.

Learned counsel for the petitioner submits that the petitioner has surrendered before the trial Court and has been released on interim bail in terms of order dated 18.04.2017. The petitioner had not appeared before the trial Court on 11.07.2016 and was declared as proclaimed offender. Learned State counsel on instructions from HC Gurdiyal Heera submits that the trial against the other four co-accused has ended in their Jyoti 2017.10.03 16:12 I attest to the accuracy and authenticity of this document

Keeping in view the fact the petitioner has surrendered before the trial Court and has been released on interim bail, this petition is allowed and the order dated 18.04.2017 is made absolute subject to the condition that petitioner shall appear before the trial Court on each and every date of hearing. In the event of his non-appearance on any date without permission of the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and take the petitioner into custody.
