**** JAISHREE THAKUR, J. (ORAL) CRM-13121-2018 This is an application that has been filed for placing on record the amended memo of parties.

For the reasons mentioned in the application, the same is allowed.

Amended memo of parties is taken on the record. This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 14 dated 06.02.2016 under Sections 498-A and 494 IPC, registered at Police Station Beas, District Amritsar.

-2This Court was pleased to pass the following order on 02.04.2018 :- "Learned counsel for the petitioner contends that the petitioner is ready to join investigation and that his arrest be stayed till such time as he returns to India. The allegations as set out in the FIR are that the petitioner left for America after solemnizing a marriage with the complainant and took all her documents, a sum of Rupees Twenty lacs and jewellary. It is contended that he is ready to come back and join investigation and that would resolve all disputes amicably.

Notice of motion.

On oral request of learned counsel for the petitioner, complainant Sumanpreet Kaur is impleaded as respondent No.2. Amended memorandum of parties be filed within a period of 7 days.

In the meantime, the petitioner is directed to deposit a sum of Rs. 20,000/- with the Registry of this Court towards litigation expenses within a period of one week. On doing so, notice be issued to respondent No.2 for 20.04.2018.

The parties are directed to appear before this Court on 20.04.2018.

The petitioner is directed to be present in Court on 20.04.2018.

In view of the fact that the petitioner is ready to join investigation and settle the disputes amicably, the arrest of the petitioner is stayed limited for a period of three weeks in order to enable him to join mediation process."

Learned counsel for the petitioner submits that the parties have

-3compromised the matter. In this regard, a report has been received from the Sub Divisional Judicial Magistrate, Baba Bakala Sahib, District Amritsar in a petition filed for quashing of the FIR on the basis of the compromise in CRM-M-20178-2018.

Learned counsel for the respondent-State has not disputed the factum of compromise between the parties.

Since the parties have compromised the matter, the petition is allowed and interim order dated 02.04.2018 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 16.07.2018 (JAISHREE THAKUR) JUDGE Whether speaking/reasoned Yes.
