The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.62 dated 16.7.2014 registered for the offences under Sections 279, 337, 338, 427 and 304-A IPC at Police Station Rureke Kalan, District Barnala.

Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.

As per the record, the present petitioner absented from the trial Court on 23.11.2016 and his bail bonds and surety bonds were cancelled Harpal Singh Parmar 2017.05.16 16:43 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-12391 of 2017 [2] and forfeited to the State and he was summoned through non-bailable warrants.

As per the arguments of the learned counsel for the petitioner earlier the petitioner was operated in Dayanand Medical College & Hospital, Ludhiana and his kidney was transplanted on 27.5.2016 and his personal appearance was exempted for earlier dates due to post operation and follow-up treatment. Now in view of the interim order dated 18.4.2017, the petitioner has surrendered before the trial Court and he has been released on interim bail by the trial Court. The petitioner has only to face the trial. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; I find merit in this petition and the same is allowed. The interim order dated 18.4.2017 passed by this Court granting interim bail to the petitioner is made absolute.
