ANIL KSHETARPAL, J. (ORAL) Prayer in the petition is to grant regular bail in FIR No.417, dated 11.09.2018, registered under Section 6 of POCSO Act, 2012, at Police Station, Sector 17/18, Gurugram.
Counsel appearing for the petitioner contends that, although, petitioner has been involved in a heinous crime, however, the medical evidence does not support the case of the prosecution. He has further drawn attention of the court to the statement of father, mother and victim, who all have been declared hostile by the prosecution. He further submits that father of the victim had earlier also field a similar complaint with the police in the State of Madhya Pradesh in 2017 with respect to his elder son against his cousin.
Without commenting on the merits of the case and keeping in view the fact that the petitioner is in custody for more than six months and NARESH KUMAR 2019.04.05 17:21 I attest to the accuracy and integrity of this document Chandigarh

No.M-8484-2019 -2the trial of the case is likely to take a long time, the petitioner is directed to be released on regular bail subject to furnishing of adequate surety to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Gurugram. Accordingly the petition is allowed with the aforesaid directions.
