The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus for issuance of directions to the respondents to take final decision on the charge sheet dated 05.01.2022 in which the enquiry proceedings have already been completed. 2.
Learned counsel for the petitioner submits that the only prayer that subsists in the present petition, is as regards the non-finalization of chargesheet dated 25.07.2023, wherein 3 enquiry officers have been changed. It is on account thereof, that the retiral benefits of the petitioner have not been released, though, he has retired after attaining the age of superannuation on 31.08.2023. He thus, at this stage, on instructions, submits that the prayer is only for directions to respondents to conclude the same in a time bound manner by granting him an opportunity of hearing.
