This is a second petition for regular bail, earlier having been dismissed as withdrawn.
Counsel for the petitioner submits that co-accused of petitioner,namely, Baljit Singh, Harbans Singh and Shanty Singh have been granted the concession of bail. The FIR was registered at the instance of Jagroop Singh alleging that on 15.5.2013 his son Resham Singh, was attacked by Balwant singh, Sandeep Singh, Kala Bua, Ranjit Singh and Kulwinder Singh along with 4/5 other unidentified persons, armed with sticks, rifle and dangs. The allegation of firing is against Balwant Singh, Kulwinder Singh and Ranjit Singh.
So far as the petitioner is concerned, he is not named in the FIR. He has been involved in the case on the basis of statement of Avtar Singh and Baljit Singh and extra judicial confession of co-accused. So far as the role of the petitioner is concerned, he has neither been attributed any injury nor any specific overt act has been attributed. In view of the fact that similarly circumstanced co-accused of the petitioner,namely, Baljit Singh, Harbans Singh and Shanty Singh have been granted the concession of bail, the petitioner can also be granted the similar relief.
The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
