Counsel for the complainant has intervened to oppose the petition contending that out of Rs. 83.25 lacs, a sum of Rs. 74 lacs only stands returned.

After considering the circumstances of the case, it is apparent that the dispute is prima facie of civil nature. The petitioner having joined the investigation, can be granted the concession of pre-arrest bail. The petition is allowed. Interim order dated 23.4.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C., without prejudice to the right of the complainant to seek recoveries, in accordance with law.
