The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent No. 2 to reissue passport to petitioners No. 2 and 3. 2.

The petitioners No. 2 and 3 are minor and they have applied for passport through their mother i.e. petitioner No. 1. Initially, they were issued passport on 30.06.2016 which was valid upto 29.06.2021. Vide application dated 09.01.2024, they applied for re-issuance of passport. Father of petitioners No. 2 and 3 is not staying with them, however, he has furnished affidavit dated 05.01.2024 (Annexure P-3) to the effect that he has no objection if passport is issued to petitioners No. 2 and 3. CWP No.4337 of 2024 -2- 2024:PHHC:025680 respondents are insisting for presence of father despite affidavit furnished by him.

Ms. Amrita Singh, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. She submits that applications of petitioners No. 2 and 3 are under consideration and petitioners are supposed to appear before passport authority on 07.03.2024. The passport authority would look into the affidavit of father of petitioners No. 2 and 3 and would decide applications of the petitioners, in accordance with law.

In the wake of statement of counsel for Union of India, the petition stands disposed of. The passport authority for its satisfaction may seek response of father of petitioners No. 2 and 3, through physical or any electronic mode.
