By way of present petition filed under Section 439 Cr.P.C., prayer has been made for grant of regular bail to the petitioner in case bearing FIR No.196 dated 18.02.2023 registered under Sections 195-A & 506 IPC at Police Station Civil Line, Sirsa, District Sirsa.

Learned counsel for the petitioner submits that the petitioner has been implicated on having given threats to the complainant/witness in FIR No.46 dated 04.04.2021, P.S. Ding, Sirsa.

The prayer made on behalf of the petitioner has been opposed by learned State counsel by referring to the conduct of the petitioner, who allegedly threatened the complainant/witness while he was going to make deposition in the Court in the previous FIR.

I have heard learned counsel for the parties and gone through the paper book. I find substance in the submissions made by learned counsel for the petitioner.

In the present case, the investigation has already been concluded with the filing of challan. Petitioner is already in the custody for the last 03 months and the trial is likely to take sometime in its culmination. Moreover the complainant/witness namely Pankaj Kumar son of Sh. Madan Lal already stands examined in the previous FIR.

Considering the aforesaid facts, I do not find any justification to extend the incarceration of the petitioner.

Accordingly, without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the concerned Trial Court/Duty Magistrate.
