CRM No. 25912 of 2015 Application is allowed and learned counsel for the petitioner is permitted to add Section 409 IPC in the headnote and prayer clause of the main petition.
CRM-M-12457 of 2015 Prayer in the instant petition is made under Section 439 Cr.P.C. for grant of regular bail in FIR No. 19 dated 28.02.2013 for offences 420, 406 and 409 of Indian Penal Code (IPC), registered at Police Station Kahnuwan, District Gurdaspur. The petitioner was not arrested in the case and declared a proclaimed person.
Learned counsel for the petitioner submits that the petitioner had gone abroad and the process was not issued to him at his address abroad. It is further submitted that the JITENDER KUMAR 2015.08.26 14:44 I attest to the accuracy and integrity of this document
CRM-M-12457 of 2015 -2petitioner surrendered on 17.12.2014 and since then he is in custody. Learned counsel also contends that the petitioner was not an employee of the department.
Learned State counsel on instructions from ASI Balkar Singh submits that the huge amount of misappropriation relating to paddy to the tune of ` 5 crores is involved. It is further submitted that the challan was presented on 12.02.2015. The petitioner is in custody since 17.12.2014 and it will take time in conclusion of the trial.
In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds with two sureties in the like amount to the satisfaction of trial Court and subject to deposit of his original passport before the trial Court. Allowed in the above terms.
