Accused petitioner- Makhan Singh has been specifically named in the FIR to be accompanied by others and found loading of sand in the trolley by using JCB Machine and tractor, concededly owned by his father. Petitioner fled away from the site. However, recovery of stolen sand alongwith tractor trolley was effected. It has been noticed that petitioner is in the habit of theft of sand from the area by carrying out illegal mining.

In view of the nature and gravity of offence, no case for grant of anticipatory bail is made out.

Dismissed.
