(Oral) The petitioner was appointed on contract basis on the post of Mali, vide appointment letter dated 02.11.2011 (P-2) but now his services has been terminated on 26.01.2019 ignoring the fact that two posts of Peon/Chowkidar as well as four posts of Library Attendant are still vacant in the college of respondent No. 3.

Learned counsel is relying upon instruction dated 02.02.2019 (P-7) which states that the contractual employees who have been relieved on arrival of regular candidates, are entitled to be detained on the vacant post and if any person has already been relieved, the department may reengage them. Without expressing any opinion on the merits of the case, this petition is being disposed of by giving direction to respondent No. 3 to consider the case of the petitioner for reinstatement on class IV post, keeping in view letter dated 02.02.2019 (P-7) and availability of vacant posts.
