...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Nishan Singh Chahal, for the petitioner.
Mr. C.L. Pawar, Sr. DAG, Punjab.
***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.85 dated 30.06.2017 registered under Section 306 IPC at Police Station Jaito, Faridkot. Learned counsel submits that petitioner is incarcerated since 14.07.2017.
Admittedly, charges have been framed. One prosecution witness has been examined. Trial is in progress, which may take some time to conclude.
In view of the above, no useful purpose would be served by detaining the petitioner any longer. Accordingly, petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Faridkot.
