It has been pointed out by the counsel appearing on behalf of the petitioner that the State had been deficient in ensuring compliance and adherence to the notified Rules and the requirement of construction of animal infirmaries and animal shelter as prescribed under the Rules as well as the requirements prescribed through notifications issued by the competent authority from time to time.

During the course of the present writ petitions, various affidavits regarding compliance(s) have been filed by the respective State Governments as well as the Animal Welfare Board of India. 5.
Counsel for the petitioner fairly concedes that the requisite infrastructure has already been put in place in accordance with the notification issued by the Government. He, however, expresses an apprehension that the respondents are likely to turn back to their old ways once the writ petitions are disposed of.

Counsel for the respondent State(s) however contend that they shall ensure the compliance of the notification dated 26.03.2001 (Annexure P-1), as amended from time to time and any other instructions that may be issued by the competent authority. The assurance of the respondents is accepted.

In view thereof, the present writ petitions are disposed of as infructuous since no further directions are required to be issued. RespondentState shall, however, remain bound by their undertaking and ensuring meticulous compliance of the directions/regulations issued by the Government from time to time.

The respondent-State shall also ensure filing of the periodic inspection/compliance reports as mandated under the Act with the respective authority as per law.
