After arguing for some time, the learned counsel for the petitioner, seeks permission of the Court, to, withdraw the instant petition. 2.

Permission granted. Accordingly, the present petition is dismissed as withdrawn.

However, liberty is reserved to the petitioner to file a fresh application, claiming the benefit of his premature release from incarceration, hence in consonance with the relevant policy (Annexure P-4), only after his spending fourteen (14) years in prison, after his conviction for an offence under Section 302 of the IPC and, consequent therewith imposition of sentence of life imprisonment, upon him.

If the afore application is filed before the authorities concerned, thereupon the latter(s) are directed to, within four weeks thereafter, make a decision thereon, in accordance with the relevant policy. March 14, 2022 ( SURESHWAR THAKUR ) 'dk kamra'
