(ORAL) This is a petition that has been filed for grant of anticipatory bail to the petitioner in case FIR No. 8 dated 08.01.2015 under Sections 406/498A IPC, registered at Police Station Zirakpur, Punjab. By order dated 24.04.2015, arrest of the petitioner was stayed. During the pendency of the petition, the petitioner also formally joined investigation as has been evident from the order dated 27.07.2015. Since the petitioner was working in the Indian Army, the names of the respondent wife and the minor child were ordered to be reflected in the service book, which order has been complied with. As on date, the complainant is receiving maintenance/allowances from the pay of the petitioner directly from the Indian Army.

CRM-M-12609-2015 -2In view of the fact that the petitioner has joined the investigation, the petition is allowed and interim order dated 24.04.2015 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C.
