R.P. Nagrath, J. (Oral) Prayer in the instant petition is made for grant of prearrest bail under Section 438 Cr.P.C. in FIR No. 118 dated 30.03.2015 for offences under Sections 323, 452, 382, 427, 506 and 149 of Indian Penal Code (IPC) registered at Police Station Basti Jodhewal, Ludhiana.

Two times the scuffle took place between the parties on 29.03.2015. On the side of petitioners three persons, namely; Abhishek, Nitish Garg and Tejinder Singh suffered injuries in the occurrence and there are about nine injures on their person whereas there were three injured, namely; Sukhdev Singh, Sham Singh and Swaran Singh on the side of complainant and injuries on their person are also simple in nature.

This is a case of version and cross-version.

CRM-M-12611 of 2015 -2In view of the above, the instant petition is allowed and the petitioners are directed to appear before the Arresting/Investigating Officer on 15.05.2015 between 11.00 a.m. to 02.00 p.m. Petitioners are also directed to keep on joining the investigation as and when required and cooperate with the same. The petitioner shall also abide by the restrictions contained in Section 438 (2) Cr.P.C. Any recovery made in pursuance to the disclosure statement would be admissible under Section 27 of the Evidence Act. In case, petitioners fail to appear before the Arresting/Investigating Officer on the date stipulated above, the concession granted to them vide this order shall automatically stand vacated.
