CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR

Present:

Mr. Neha Jain, Advocate for the petitioner.

Mr. M.S. Nagra, DAG, Punjab.

Mr. Gurpal Singh Sandhu, Advocate for the complainant.

-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of anticipatory bail to the petitioner in FIR No.0014 dated 09.02.2021 under Sections 304B and 34 IPC registered at Police Station Kotbhai, District Sri Multsar Sahib. Learned counsel for the petitioner herein would contend that the allegations levelled in the FIR are absolutely false as there is no demand of dowry. It is argued that the demand for an air conditioner is not believable on account of the fact that family of the petitioner is already in arrears of payment of electricity charges. It is also argued that the custodial interrogation of the petitioner herein would not be required as the son of the petitioner i.e. husband of the deceased is already in custody. Notice of motion.

Mr. M.S. Nagra, DAG, Punjab, who is present through the medium of video conferencing accepts notice for the respondent-State and would submit that the marriage took place only in November, 2020 and within a period of three months thereafter, there is death of a young lady. CRM-M No.11453 of 2021 (O&M) -2I have heard learned counsel for the parties and found no ground to allow present bail application.

Faced with this situation, learned counsel appearing on behalf of the petitioner would submit that the petitioner would surrender before the trial Court within a period of one week and on her doing so, in case an application for grant of regular bail is filed, the same may be considered in accordance with law.

The prayer made by the counsel appearing for the petitioner herein is innocuous and therefore, the instant petition is disposed of with the observation that in case the petitioner surrenders before the trial court within a period of one week from today and files an application for grant of regular bail, the same be considered by the trial court in accordance with law.
