Mr.Gaurav Dhir,DAG Haryana with SI Resham Singh Mr.Mohan Singh Rana,Advocate for the complainant. Jaswant Singh,J(Oral) Prayer under Section 482 Cr.PC is for grant of pre-arrest bail in complaint case No.122/2014 dated 1.5.2014 titled as Rajinder Kumar v Balbir Singh and another under Section 3(ii) and 3(x) of SC/ST Act, pending in the Court of SDJM,Kalka, however, summoned under Section 3(1)(x) of SC/ST Act.
Petitioner was a Duty Clerk at Sub-Depot Haryana Roadways, Kalka and on the day of occurrence on 27.3.2013 at 10-11 am on refusal to accommodate the complainant, a Driver, regarding his duty hours, false allegations have been made. Vide order dated 25.4.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court within 10 days, petitioner be released on interim bail. At the time of hearing today,learned counsel for the petitioner states that in compliance of the said order, petitioner surrendered before the trial court on 27.4.2016 and was released on interim bail.

CRM-M 13666/2016 Learned State counsel on instructions is unable to refute the said factual position,whereas counsel for the complainant opposes the relief sought in the present petition.
In view of the above interim bail granted by the trial court, pursuant to the order dated 25.4.2016, is made absolute. Disposed of.
