R.P. NAGRATH, J. (ORAL) Prayer in the instant petition filed under Section 438 Cr.P.C. is for grant of pre-arrest bail to the petitioners, namely; Gurdev Singh and Surinder Pal Singh in FIR No. 150 dated 19.10.2013 registered under Sections 420/465/468/471/120-B of the Indian Penal Code at Police Station Kartarpur, District Jalandhar.

On instructions from ASI Vijay Singh, learned State counsel submits that both the petitioners were declared proclaimed offenders by the learned Chief Judicial Magistrate, Jalandhar on 20.10.2014 in the instant FIR which fact is not mentioned in the instant petition. Learned counsel for the petitioners submits that the petitioners were not aware of this fact but of course in that event, the prayer for pre-arrest bail will not lie.
