ASHOK KUMAR VERMA, J. (ORAL) The petitioner has filed the present petition under Section 439 Cr.P.C., for grant of regular bail in case FIR No. 230 dated 19.12.2019 registered under Section 22 of the NDPS at Police Station Dakha, District Ludhiana.

According to the prosecution story, the aforesaid FIR was registered on the basis of a secret information and the police apprehended the petitioner. On her personal search, 123 intoxicant tablets were recovered and thereafter, on the basis of her disclosure statement, another 700 intoxicant tablets were got recovered which were also taken into police possession.

Learned counsel for the petitioner inter alia contends that the petitioner is repeatedly involved in number of cases in the same RISHU KATARIA 2023.04.20 13:50 I attest to the accuracy and authenticity of this order/judgment

He further contends that vide order dated 02.03.2020, passed by a co-ordinate Bench of this Court, the petitioner was released on interim bail. Learned counsel also contends that the trial is at the stage of recording the prosecution evidence and will take sufficient long time in its conclusion. The petitioner never misused the concession of interim bail. Thus, it is prayed that the instant petition may be allowed by granting the concession of regular bail to the petitioner. On the other hand, learned counsel for the State vehemently opposed the submissions made by learned counsel for the petitioner.

Keeping in view the facts and circumstances of the case and also the fact that petitioner had already been granted the concession of interim bail vide order dated 02.03.2020 passed by a co-ordinate Bench of this Court, but without commenting on merits of the case, the instant petition is disposed of, with a direction to the petitioner to appear before the trial Court within a period of 04 weeks' from today and shall file an application for grant of regular bail and on doing so, the trial Court shall release the petitioner on regular bail, subject to her furnishing fresh bail/surety bonds to the satisfaction of the trial Court. 19.04.2023 (ASHOK KUMAR VERMA) rishu JUDGE Whether speaking/reasoned Yes/No Whether Reportable Yes/No RISHU KATARIA 2023.04.
