Ramendra Jain, J (Oral) Through the instant petition under Section 439 Cr.P.C., prays has been made for grant of regular bail to the petitioner in case FIR No.8 dated 19.01.2018 under Sections 295-A, 323, 341, 148, 149, 379-B IPC and Section 27 of the Arms Act, registered at Police Station, Division No.3, Jalandhar.

According to the prosecution, in the morning of 18.01.2018, petitioner alongwith his companions intercepted the complainant and badly beaten him up. They also removed his turban with intention to religiously intimidate him besides forcibly snatching of his Camera. CRM No.M-8637 of 2019 [2] Learned counsel for the petitioner contends that parties have effected a compromise. Petitioner is in custody since 24.01.2019. Petitioner has falsely been implicated.

Learned State counsel has opposed the petition. However, learned counsel for the complainant, admitting the factum of compromise between the parties, submits that he has no objection, if the petitioner is granted the concession of bail in view of compromise. Having heard learned counsel for the parties and considering the facts & circumstances of the case as also the fact that petitioner is in custody since 24.01.2019, he is ordered to be released on bail subject to furnishing bail and surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate, Jalandhar.

The petition is accordingly allowed.
