State of Haryana .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Chankya Pandit,Advocate for the petitioner Mr.Kuldip Tiwari,Addl.AG Haryana assisted by ASI Nihal Singh Jaswant Singh,J.(Oral) Prayer is for grant of regular bail on behalf of Hardeep Singh in case FIR No.351 dated 25.12.2014 under Sections 392/34 IPC and Sections 25/54/59 of the Arms Act (Sections 395,397,412 IPC added on presentation of challan),PS Ellenabad, District Sirsa. As per FIR got recorded by complainant Dharam Chand, a sum of Rs.46 lacs was looted from R.K.Cotton Mills on gun point by two young boys, who after committing the crime fled away on a motorcycle driven by third accused.

Upon notice, reply has been filed by way of affidavit of Kuldeep Singh Beniwal,DSP Ellenabad wherein it is stated that during investigations, one Sandeep co-accused who used to work as RAJINDER PRASHAD JOSHI 2016.02.26 16:20 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CRM-M 1369/2016 Supervisior in RK Cotton Mills was arrested and on his disclosure statement, names of eight accused, including that of the petitioner surfaced. Out of those eight, seven have been arrested while co-accused Shakti @ Manjit @ Sanjit is yet to be arrested. As per disclosure statements of accused-petitioner Hardeep, who was allegedly a member of the said gang, out of said loot, a sum of Rs.50,000/- was given to him by said co-accused Shakti. A sum of Rs.15,000/- was got recovered by the petitioner.

It is submitted by the learned counsel for the petitioner that he is in custody since 26.7.2015 and no other case is pending against him.

Without commenting on the merits of the case, in view of the nature and gravity of offence, no case for grant of regular bail is made out.

Dismissed.
