******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 19 dated 10.03.2017 registered for offences punishable under Sections 452, 323, 506, 427, 148 read with Section 149 of Indian Penal Code (for short 'IPC'), at Police Station Mamoon Cantt., Shahpur Kandi, District Pathankot.

Heard.

As per case of prosecution, petitioner, who was employed with Gurwindervir Singh had gone to his showroom and caused injuries on the person of complainant-Kishore Lal with baseball bat. The complainant was taken to hospital, where he received a call that petitioner had again come to the showroom with certain persons and smashed the windowpane of the cabin and also gave threats.

CRM-M-12743 of 2017 -2only gone to settle his account and get his pay and has been falsely implicated. In the occurrence he had also received two injuries as per MLR, copy of which has been placed on file and he had made a complaint to police on which no action was taken.

Learned State counsel submits that copy of MLR of the petitioner was received and he was called to police station but has not turned up.

Keeping in view the manner in which the occurrence had taken place, I do not find it to be a fit case to extend the benefit of anticipatory bail to the petitioner.
