!"# $ Allegations against the petitioners Geeta Rani and Ami Chand in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.358 dated 21.12.2014 registered at Police Station Dharamkot, District Moga under Sections 406/420 IPC are that on 20.11.2013 they enticed and fraudulently taken a sum of 7,24,000 from complainant Santosh wife of Des Raj who happens to be the mother of Geeta Rani petitioner No.1, on the pretext that they will buy her a house out of this amount at Dharamkot.

Contentions of learned counsel for the petitioners Mr.Ashish Gupta, Advocate that the petitioners were not connected with the transaction as sale proceeds which were alleged to have been given to them were out of the house claimed to have been sold by the petitioners which was not in the name of petitioner Geeta Rani and that her sister Sushma @ Madhu was holding power of attorney. The same is opposed by learned State counsel contenting that the petitioner Geeta Rani has committed fraud with her own mother and handicapped brother and that custodial interrogation of the petitioners is very much necessary.
Keeping in view the allegations and the fact that investigations are still underway and the conduct of the petitioners disentitles them of any relief. Thus, the present petition stands dismissed.
