(ORAL) The limited question for which the convict has come up before this Court for quashing of order dated 03.12.2021 whereby condition for deposit of 20% of the cheque amount/compensation during the pendency of the appeal before the learned Appellate Court was directed.

Given the nature of the order that this Court proposes to pass, no response of the respondent is required.

This Court requests the learned Appellate Court to decide the main appeal itself positively on or before 30.09.2022 and during such period, the Court shall not insist the convict for depositing of 20% of the compensation amount. It is clarified that in case the petitioner/convict seeks adjournment then the learned Appellate Court may proceed further by appointing legal aid counsel but no adjournment shall be given to the petitioner/appellant. The convict/appellant is directed to appear before the learned Appellate Court on 05.08.2022 failing which this order shall be deemed to have been recalled without any further reference to this Court.

Given above, the present petition is allowed to the extent above. All pending applications, if any, stand disposed of.
