This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 182 dated 02.10.2013 under Sections 302, 365, 342, 201 & 120-B IPC at Police Station Division no. 5, Ludhiana. Learned counsel for the petitioner contends that petitioner is innocent and has been falsely implicated in the case. According to him, investigation is complete and challan presented before the competent court. Thus, no useful purpose would be served by detaining the petitioner in custody any longer. Learned State counsel has opposed the plea.

FIR was lodged by one Ashok Kumar. It was alleged that Harjinder Singh @ Jinder (petitioner herein) in connivance with other accused had acted in well planned conspiracy as they intended to grab the property of deceased Supreet Singh. They took the deceased to various hotels and administered liquor as well as other drugs. CRM M-12708 of 2015 substance. Accused placed dead body of deceased in a Scorpio vehicle and took him to the house of Karampal Singh @ Bablu. Body was thrown in the roundabout of Kochar market. This was done with a view to grab the property of deceased Supreet Singh. During investigation, statement of Kulwant Singh was recorded who stated that on 19.07.2013 at about 1.30 a.m. he saw three persons namely Karampal @ Babloo, Mohinder Singh and Harjinder Singh (petitioner herein) throwing the body of deceased at kochar market. It was also found that petitioner had usurped one house of deceased Supreet Singh situated Taraf Karabara and thereafter committed his murder.

In view of nature of allegations, I am of the considered view that petitioner is not entitled to concession of bail. Plea of the petitioner can be examined only when some evidence is lead before the trial court. No merits. Dismissed.
