(Oral) Prayer in this petition filed under Section 528 of BNSS, 2023, is for quashing of order dated 24.10.2024 (Annexure P-7) passed by learned Judicial Magistrate Ist Class, Ludhiana, in case i.e. CHI1727 of 2018, titled as "State of Punjab vs Kapil Chawla and another", arising out of FIR No.189 dated 12.08.2017, registered under Sections 325, 323, 506, 34 IPC at Police Station Shimlapuri, Ludhiana, vide which the application filed under Section 311 Cr.P.C. has been allowed. Learned counsel for the petitioner wishes to withdraw the present petition with liberty to raise the plea of admissibility and the relevance at the time of final arguments.
