(ORAL) Through this petition under Section 482 Cr.P.C., prayer has been made for quashing order dated 01.04.2017 (Annexure P-4) of the trial Court, dismissing the application of the petitioner under Section 311 Cr.P.C., seeking permission to tender certain documents by way of additional evidence.

Heard.

By this time, it is well settled that none should be non-suited on technical ground. According to the complainant-petitioner, he had obtained certain documents through RTI, after closure of his evidence. Now, he wants to produce the same on record. Had he been received those documents earlier, before closure of his evidence, he must have tendered the same, but necessity arose to exhibit them by way of additional evidence as the same were received afterwards. CRM-M-12833-2017 -2Considering the above aspect of the matter, the impugned order Annexure P-4 is set aside and the application of the petitioner under Section 311 Cr.P.C. is allowed. The trial Court is directed to afford an opportunity to the petitioner to produce the documents, which are mentioned in his application under Section 311 Cr.P.C., by way of additional evidence.
