*** The case has been taken up through Video Conferencing. Learned counsel for the petitioner states that petitioner has since joined the investigation and has been released on interim bail, therefore the interim order dated 27.2.2020 be made absolute. He has contended that it is basically a dispute between Rita Devi and her husband Ashok Kumar and petitioner has been dragged in the matter being relative of Rita Devi alleging that Rita Devi was having illicit relations with petitioner accused Sukhwinder Singh since childhood and she had made her obscene video leveling false allegations against her husband Ashok Kumar. As a matter of fact, Sukhwinder Singh has got nothing to do with preparation of such video clip.
Learned State counsel on instructions from ASI Karnail Singh has admitted the factum of petitioner having joined the investigation and as stated by the petitioner the video clip(s) in question are no longer in PARVINDER SINGH 2021.07.27 16:08 I attest to the accuracy and integrity of this document
CRM-M-8503 of 2020 existence, therefore, custodial interrogation of the petitioner is not required. Under such circumstances, the interim bail granted to the petitioner on 27.2.2020 is made absolute, subject to the following conditions :- (i) he shall join the investigation as and when so directed. (ii) he shall appear in the Court on each and every date of hearing.
(iii) he shall not give any threat or intimidation to the prosecution witnesses.
(iv) he shall not leave India without prior permission of the Court.
(v) he shall surrender his Passport before the Investigating Officer and if he is not having Passport then shall file the affidavit in that regard. In case the petitioner violates any term and condition on which the bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.
The petition stands allowed accordingly.
