Criminal Misc.No.M-128 of 2015 [1]

IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH Criminal Misc.No.M-128 of 2015 Date of Decision: January 06, 2015 Sanjeev Kumar

...Petitioner

Versus

State of Punjab

...Respondent

CORAM: HON'BLE MR. JUSTICE NARESH KUMAR SANGHI

Present:

Mr.Rishu Mahajan, Advocate, for the petitioner.

Naresh Kumar Sanghi, J.(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, Sanjeev Kumar, who has been booked for having committed the offences punishable under Sections 120B, 420, 465, 467, 468 and 471, IPC, in a case arising out of FIR No.257, dated 02.07.2009, registered at Police Station, Civil Lines, Amritsar.

Learned counsel contends that after registration of the case, the petitioner was granted bail and he was regularly attending the proceedings before learned trial court; on 11.07.2014 due to his illness, the petitioner could not appear before learned trial court and as such, his bail bonds forfeited to the State and non bailable warrants were issued for securing his presence. He further submits that only for one date, the SEEMA RANI 2015.01.06 15:50 I attest to the accuracy and authenticity of this document Chandigarh

Criminal Misc.No.M-128 of 2015 [2] petitioner did not appear before learned trial court and as such, the forfeiture of the bail bonds were unjustified. I have heard the learned counsel for the petitioner and with his able assistance gone through the material available on record.

The contention raised by learned counsel that the petitioner remained absent on 11.07.2014 is misconceived. In fact he did not appear before learned trial court on 11.07.2014, 17.7.2014 and 21.08.2014.

No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
