Nafe Singh v. State Of Haryana
The petitioner seeks grant of anticipatory bail in respect of a case registered vide FIR No.1, dated 25.1.2023 at Police Station SVB Karnal, under Sections 7, 13(1)(b) and 13(2) of Prevention of Corruption Act, 1988 and Section 120-B of Indian Penal Code.
Learned counsel for the petitioner submits that although the petitioner is named in the FIR but even if all the allegations as levelled in the FIR are taken to be correct, the only allegation against the petitioner is to the effect that the complainant had met the petitioner i.e. Nafe Singh, Patwari and had discussed the matter pertaining to complainant's appeal with the petitioner and the petitioner told the complainant to meet Satbir Singh,Chakbandi Officer and accordingly the petitioner met Satbir Singh, who demanded a bribe of Rs.5 lakhs, which was settled at Rs.4 lakhs, and later said Satbir Singh was caught red-handed while accepting an amount of Rs.50,000/-.

payment of any illegal gratification to anybody or any amount was ever recovered from him and that he has falsely been implicated.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
