Jaswant Singh,J(Oral) Prayer is under Section 438 Cr.PC read with Section 482 Cr.PC for grant of anticipatory bail to petitioners, namely Natha Singh and Gurbachan Singh in the complaint case no.28 dated 17.7.2014 titled as Bhag Singh v Natha Singh under Sections 3(3,10) of SC/ST (Prevention of Atrocities)Act,1989 and Sections 323,379,506,295-A and Section 34 IPC, pending in the Court of learned JMIC, Jagraon. Petitioner Natha Singh is stated to be 60 years old and his co-accused brother Gurbachan Singh about 80 years of age. It was contended that a false case has been foisted upon both the accused-brothers as a counter blast to the petitioner no.1 having deposed against the complainant in civil suit and criminal RAJINDER PRASHAD JOSHI 2016.05.12 19:11 I attest to the accuracy and integrity of this document

Vide order dated 26.4.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court within 10 days, petitioners be released on interim bail. At the time of hearing today,learned counsel states that in compliance of the said order, petitioners surrendered before the trial court within the permitted time and were released on interim bail. Learned State counsel on instructions is unable to refute the said factual position while learned counsel for complainant opposes the grant of relief sought for in the present petition. In view of the above interim bail granted by the trial court, pursuant to the order dated 25.4.2016, is made absolute. Disposed of.
