***** ARUN MONGA, J. (ORAL) Appeal was filed in the year 1990 and was admitted for hearing on 11.07.1990 and has been pending ever since. On the last date of hearing, when matter was taken up for hearing, none appeared for either side of the parties and Registry was asked to issue fresh notice to both the sides in the interest of justice, since they might not have been aware of listing of the case. Pursuant thereto, needful has been done and office report reveals that notice issued to parties received with report "incomplete addresses".

In the premise, for lack of proper particulars of address, issuance of another notice would be an exercise in futility. It may be highly possible that by sheer efflux of time, appeal is rendered infructuous and that is why none appears for either side.

Be that as it may, appeal is dismissed in default. 4.
