VINOD S. BHARDWAJ, J. (Oral) The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for seeking quashing of FIR bearing No.174 dated 07.12.2024, under Section(s) 308(6), 318(4), 336(3), 338 and 340 of the Bharatiya Nyaya Sanhita, 2023, registered at Police Station Cyber Crime Ballabgarh, District Faridabad, along with all the consequential proceedings arising therefrom on the basis of compromise dated 18.12.2024.
CRM-M-9175-2025 (O&M) -2State counsel contends that even though quashing of the FIR on the basis of compromise has been prayed for, however, it is a case where two of the accused persons namely Shiv Charan and Vikas have neither been impleaded as a party nor any settlement has been arrived at with them. Further, it is noticed that as per the report sent by the Judicial Magistrate First Class, Faridabad, vide Memo bearing No.85 dated 26.03.2025, said accused persons have not been arrested till date and as many as 439 cyber complaints are stated to be pending against the other three accused persons (petitioners herein).
In view of the Division Bench judgment of this Court passed in the matter of Rakesh Das Vs. State of Haryana and another, CRM-M48043-2023, decided on 12.11.2024 along with other matters, wherein it has been laid down that partial quashing of the FIR is not permissible and therefore, present petition cannot be entertained at this stage. There is no representation on behalf of the petitioner(s) as well as respondent No.2.
In view of the Division Bench judgment of this Court in the matter of Rakesh Das (supra), the present petition is dismissed at this stage. February 19, 2026.
