(ORAL) Present writ petition has been filed for directing respondent No.1 to decide the statutory appeal dated 02.05.2023 (Annexure P-25) filed by respondent No.3 as directed by this Court vide order dated 22.12.2023 (Annexure P-27) in petition bearing CWP No.29167 of 2023 to decide the appeal within a period of two weeks and further even in regular inquiry report No.266, dated 24.01.2023 (31.01.2024) allegations of illegal mining has been proved against respondent No.3 and despite various reports submitted by various authorities showing the illegal act and conduct of respondent No.3 regarding illegal encroachment over Panchayat land, FIRs against him, illegal mining etc., no action is being taken against him. Further prayer has been made that after the order dated 22.12.2023 (Annexure P-27) passed by this Court in CWP No.29167 of 2023, the statutory appeal of respondent No.3 was listed for hearing on RITTU 2024.02.27 13:31 I attest to the accuracy and integrity of this document

CWP No.4482 of 2024 -22024:PHHC:026877 11.01.2024 and on said date they sought adjournment to argue the matter and accordingly, the case was adjourned time and again and finally the case was adjourned to 15.02.2024.

Learned counsel for the petitioner has inter alia contended that the petitioner has filed the appeal which is pending adjudication before respondent No.1. He submits that various dates have been fixed but till date no hearing has taken place in the appeal. He has submitted that last date fixed in the appeal was 15.02.2024. He submits that the appeal be decided expeditiously.

Notice of motion to the official respondents at this stage. On asking of the Court, Mr. Navneet Singh, Sr. DAG, Punjab appears and accepts notice on behalf of respondents No.1 and 2State. He has submitted that appeal of the petitioner would be decided expeditiously.

In view of the above position, the present petition stands disposed of with a direction to respondent No.1 i.e. Secretary, Department of Rural Development & Panchayat, SAS Nagar, Mohali, Punjab to take up the appeal filed by the petitioner and decide the same after hearing both the sides in accordance with law expeditiously.
